General Terms and Conditions

of Private Cooking`s Chef Services

1.- Scope and general considerations

The following General Terms and Conditions, along with any particular conditions agreed, shall apply to the services provided by Chef Caroline Fabian, whose registered office is located at:

Private Cooking is a private chef service which brings the finest haute cuisine to clients’ own homes, yachts and estates for the clients’ and their guests’ satisfaction. The services include private chef services for events or holidays, as well as market tours and wine counselling.

2.- Information on services

Detailed descriptions, pictures, graphic and iconographic representations and videos on Private Cooking services can be found at www.privatecooking-mallorca.com. The corporate name, registered trademark or other distinctive signs which can also be found at this website add further information on the services provided by Chef Caroline Fabian.

Private Cooking reserves the right to decide which services will be delivered at any time.

3.- Booking process

With Private Cooking clients can book private chef services online by sending an email address to caroline@privatecooking-mallorca.com. Please contact us for additional information on services and menu choices. Displayed menus may vary at the discretion of Private Cooking. However, Private Cooking commits to maintain the products and prices for agreed services. 

Upon confirmation of the services by e-mail or telephone, clients shall pay 30% of the anticipated cost within seven days. This payment is to be deposited by bank transfer to the account detailed in the booking summary sent out in a confirmation e-mail.

The Client and Private Cooking will agree the date and time of the service at least 15 days prior to the scheduled date of the event. Private Cooking will notify the Client that at least three hours are required to prepare the event. Should the Client fail to provide access to the event site three hours ahead of the scheduled time, Private Cooking will not be liable for possible delays in delivery.

Since Private Cooking services are rendered on the day of the event, access to the private kitchen and use of the kitchen equipment shall be guaranteed. Private Cooking reserves the right to modify the menu in the event that the Client’s kitchen is not conveniently equipped.

4.- Prices

The services provided in private houses, yachts or estates are calculated on a daily rate which depends on the number of guests and meals. Products, flatware, glassware and cutlery are not included in the price and a break-down of related costs will be furnished. Total cost of these items shall be included and furnished together with the quotation for the agreed service.

All prices include the legal Spanish VAT of 10% applicable on food products and the legal Spanish VAT of 21% for services.

 4.1. Event prices

Clients hiring Caroline Fabian for an event or a showcooking shall receive a separate quotation per person.

4.2. Packages prices

Detailed information on cooking packages for several days can be found at our website “Special offers” . The number of people and the services cannot be modified in the case of packages.

Private Cooking offers all inclusive packages. Spanish VAT is also included in the price.

5.- Payment conditions

Once the services have been agreed and upon receipt of the quotation, clients shall pay a deposit of 30% of the total cost (VAT included) by bank transfer. Only after receipt of the deposit the booking will be secured. If services are contracted less than 5 days in advance, the bill will be due on the date of the event. Cash payments can only be received up to a maximum of €2,500, VAT included. Private Cooking reserves the right to cancel the event should the Client fail to pay the 30% deposit.

The remaining 70% may be paid by bank transfer up to three days prior to the event and/or up to three days upon receipt of the final invoice.

All services are invoiced. The tax base and the VAT are separately displayed on the invoice.

 6.- Substitution of products

Private Cooking takes pride in promoting traditional regional and seasonal products. Should any product of the agreed menu not be available at the time of the event, or not be of the best quality, Private Cooking reserves the right to provide a suitable alternative.

In the event that any product is substituted, Private Cooking shall inform the Client at least 24 hours in advance. 

7.- Cancellation policy

Where the Client cancels a contract up to 15 days before the start of the event, Private Cooking will refund all amounts paid by the Client, provided that no costs arising from preparation work or contracts with third-parties are incurred by Private Cooking. These costs, if any, will be deducted from the 30% deposit paid by the Client after providing the corresponding proof for the expenses.

Where an event is cancelled between 14 and 3 days before the start of the event, Private Cooking reserves the right to hold the 30% deposit of the net invoice to cover the expenses incurred by Private Cooking in relation to the purchase of products and supplies.

Where an event is cancelled within 2 days or less of the scheduled event date the Client shall remain liable to pay 100% of the total cost.

8.- Personal data protection

 The clients’ data required for preparing the quotations and providing the services shall be incorporated to a file controlled by Caroline Fabian. Such file is duly registered in the General Registry of the Spanish Agency for Data Protection. Clients may exercise their right to access, rectify, cancel and/or challenge their personal data at any time by sending written request to caroline@privatecooking-mallorca.com where a copy of their ID card or passport must be enclosed.

 9.- Applicable jurisdiction and venue

These Terms and Conditions are governed by the Spanish Law. Any dispute or controversies arising from their interpretation and/or performance shall be resolved by the Spanish Courts where the Client is domiciled.
